Trademark Registration for Business Name: More Than a Name, It Must Be Protected

Trademark registration for a business name is something many owners think about only after their brand has grown. When we start a business, we first find a good name, then a logo, social media pages, and a website. Slowly, people begin to trust that name. But we often don’t think about whether someone else is already using it, or how it can be legally protected.

In September 2026, complaints were raised against a catering establishment in Kottayam over the delivery of wedding feasts (sadya). As the news spread, some people mistook another catering business with a similar name for the one in the news. That business had to face numerous abusive phone calls and lost many orders.

Think about how distressing it must be for a business built through years of hard work to go through such an experience simply because of name confusion with another establishment.

What Is Trademark Registration for a Business Name?

A trademark is a sign, such as a business’s name, logo, or symbol, that helps identify its products or services and distinguish them from those of others.

In India, trademark registration is carried out under the Trade Marks Act, 1999. When an eligible trademark is registered, the owner gets legal rights over the specific goods or services connected with the registered mark. This may help the owner take legal action against others who use the same mark, or one that causes confusion.

However, using similar names is not automatically illegal in every situation. Existing rights, the nature of the services, the similarity between the names, and other legal factors need to be examined.

Business Registration and Trademark Registration Are Not the Same

Company registration, GST, and Udyam are permissions to run a business. They do not give trademark protection to the brand name. Only trademark registration for a business name secures that right

This matters even more in fields like weddings, event management, photography, decoration and catering services, . Here, customers choose a business based on hearing its name and on recommendations from relatives. Because there are many similar names, the chance of confusion is also higher.

What Problems Can Arise Without Trademark Registration?

If a business name has been used for years but its legal protection has not been secured, some challenges may arise. Legal disputes may arise with another establishment using a similar name, along with confusion among customers. Legal problems may also arise if someone else already holds registered rights to that name.

If the name has to be changed, the website, social media, logo, boards, advertisements, and so on will all have to be changed. This may affect the brand recognition and customer relationships built over the years.

That said, it cannot be said that a business without trademark registration has no legal rights at all. Under Indian law, in some situations, those who have been using a mark from earlier may also have rights over an unregistered trademark. But this is harder to prove, so each situation must be assessed separately.

What to Check Before Applying Trademark Search:

Check IP India’s Public Search to see whether the same name, a similar name, or a name that sounds alike already exists. The fact that a domain or Instagram username is available does not mean the name is free under trademark law.

The Right Class: India follows the Nice Classification, which has 45 classes. Services such as events and shows usually fall under Class 41, catering under Class 43, and advertising and business management services under Class 35. Services like wedding planning may fall under Class 45. The classes should be chosen according to the services you actually provide. A wrong class may affect your protection.

Eligibility for Registration: Very generic names and words that directly describe the service may face obstacles in registration.

Word Mark, Logo: You can apply for the name alone or along with the logo. The scope of protection will vary accordingly.
Once these checks are complete, you can submit the application through IP India. You may use the ™ symbol until registration is granted; the ® symbol may be used only after registration is received. Seeking the help of a trademark attorney can make the application process easier.

Why is trademark registration for a business name important?

It gives the owner legal rights over the name for the registered goods or services, and may help in taking action against others who use the same or a confusingly similar name.

How can I check whether a business name is available?

You can check IP India's Trademark Public Search for the same name as well as similar names.

Do I need a trademark if I have company registration?

Yes. Company registration does not give trademark protection to the brand name.

How much time and cost does registration involve?

The fee varies depending on the type of applicant and the number of classes. Refer to IP India's fee schedule.
The process usually takes anywhere from a few months to more than a year. Registration is valid for 10 years and can then be renewed.
